Advocacy in industrial relations tribunals

Learn to plan successful appearances before the Tribunals and develop quality advocacy skills with industry experts. With real life situations, gain practical skills and experience with sitting Tribunal members.

About this course

This 10 week course will teach participants working in industrial relations or human resource management how to plan successful appearances and will develop quality advocacy skills.

It is predominantly a skills-based course, providing participants with the opportunity to experience real life situations and better build on their skills in presenting in Tribunals.

  • Case Preparation I: Planning the Case
  • Research Methods for Advocates
  • Mediation and Workplace Disputes
  • Preparing Submissions
  • Unfair Dismissals in the Federal and State Systems
  • Case Preparation II: Preparing Written Evidence
  • Examination in Chief – an Introduction
  • Introduction to the jurisdiction and functions of the Industrial Relations Commission of NSW
  • Disputes under the Fair Work Act
  • Cross-examination: Introduction and examples
  • Discrimination Law, the Federal Circuit Court and Equal Opportunity Division of the NSW Administrative Decisions Tribunal.

No pre-reading is required.

UTS Business School runs this course supported by the Industrial Relations Society of NSW and the Fair Work Commission. The course offers moots in multiple jurisdictions with presented before tribunal members.


Learning outcomes

By the end of this course participants will:

  • Understand the key aspects of preparing and presenting cases before Industrial Relations Tribunals
  • Be aware of appropriate professional practice when appearing before tribunals
  • Have developed skills regarding case research and the preparation of evidence
  • Have developed cross-examination skills
  • Developed confidence in presenting a case before a tribunal.
